Terms of Use

1. Acceptance of these Terms

By creating an account, signing in, or using Katye, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy, which is incorporated by reference. These Terms form a binding contract between you and Contingency Entertainment.

2. Who can use Katye

• You must be at least 13 years old.
• Where applicable law requires parental consent for minors, your parent or legal guardian must agree to these Terms on your behalf.
• You must comply with all applicable laws of your jurisdiction when using Katye.
• We do not knowingly allow accounts from individuals under 13, and we may close any account we believe was created by an underage user.

3. Your account

• You are responsible for the security of your sign-in credentials.
• One person, one account. Do not share, sell, transfer, or trade accounts.
• You agree to keep your account information accurate and up to date.
• We may suspend, restrict, or delete accounts that we believe violate these Terms, with or without notice and in our sole discretion.

4. License to use Katye

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use Katye for your personal, non-commercial entertainment. We may revoke this license at any time, in our sole discretion, for any reason.

5. User-generated content and gameplay data

When you vote, pick a team, choose a display name, complete a puzzle, or take any other action in Katye, you grant Contingency Entertainment an irrevocable, perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, display, aggregate, and analyze your gameplay actions and any content you submit, for the purpose of operating the Service, computing leaderboards, producing aggregated statistics, generating marketing materials, and improving the Service.

You represent and warrant that any display name or other content you submit (a) is accurate, (b) does not infringe the intellectual property, privacy, publicity, or other rights of any third party, (c) is not unlawful, hateful, defamatory, obscene, or harassing, and (d) does not impersonate any other person.

6. Prohibited conduct

You agree NOT to:

• attempt to reverse-engineer, decompile, disassemble, or extract source code from the App;
• use bots, scrapers, automated scripts, multiple accounts, or any technique to inflate scores, cast multiple votes, or otherwise game the leaderboards or puzzles;
• impersonate any person or misrepresent your affiliation with any entity;
• post, transmit, or distribute any content that is unlawful, infringing, hateful, harassing, defamatory, obscene, threatening, or that violates anyone’s rights;
• introduce malware, viruses, worms, or any harmful code into the Service;
• attempt to gain unauthorized access to any system, account, or data on the Service;
• collect, harvest, or otherwise scrape data about other users, including their email addresses, display names, gameplay history, or device identifiers;
• use the Service for any commercial purpose without our prior written consent;
• circumvent or interfere with any security, rate-limiting, or anti-abuse measure;
• encourage or assist any third party in doing any of the foregoing.

7. Intellectual property

• Katye and all of its content — including but not limited to the design, the mascot Kato, the daily puzzles, the music battles, the source code, and all artwork — are owned by or licensed to Contingency Entertainment LLC.
• “Katye,” the Katye logo, and “Kato” are trademarks of Contingency Entertainment LLC. You receive no rights to our trademarks, copyrights, patents, trade secrets, or other intellectual property.
• Third-party trademarks, song titles, and artist names referenced in Katye remain the property of their respective owners.

8. Third-party services and stores

Katye integrates with third-party services including, without limitation, Google AdMob, Google OAuth, Apple Sign in with Apple, Supabase (authentication + database), OneSignal (push notifications), Firebase (Android push delivery), and the Apple App Store and Google Play Store. Your use of those services is governed by their own terms and policies. We are not responsible for third-party services or their content.

Advertising. Katye is supported by ads served through Google AdMob. We do not control which specific ads are shown to you.

In-app purchases and subscriptions.Katye may offer optional purchases or subscriptions (such as Katye Premium). All purchases are processed by Apple or Google through their respective stores under their terms. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period; manage or cancel renewals in your device’s subscription settings.

9. Disclaimer of warranties

Katye is provided “as is” and “as available” without warranties of any kind, express or implied. To the fullest extent permitted by applicable law, Contingency Entertainment LLC, its members, officers, employees, contractors, and affiliates disclaim all warranties, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, title, accuracy, completeness, availability, reliability, and quiet enjoyment.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. You use the Service at your sole risk.

10. Limitation of liability

To the maximum extent permitted by applicable law, in no event will Contingency Entertainment LLC, its members, officers, employees, contractors, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; for any loss of profits, revenue, data, goodwill, business opportunities, or use; or for any cost of substitute services, whether arising from contract, tort (including negligence), strict liability, or any other legal theory, and even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for any and all claims arising out of or relating to these Terms or your use of Katye will not exceed the greater of (a) the total amount you have paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) USD $100.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities; in those jurisdictions, the disclaimers and limitations above apply to the maximum extent permitted by applicable law.

11. Indemnification

You agree to defend, indemnify, and hold harmless Contingency Entertainment LLC, its members, officers, employees, contractors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees and litigation costs) arising out of or related to (a) your use or misuse of Katye, (b) your breach of these Terms, (c) your violation of any applicable law, (d) your violation of any third party’s rights (including intellectual property and privacy rights), or (e) any content you submit through the Service.

12. Termination

• You may stop using Katye and request account deletion at any time.
• We may suspend, restrict, or terminate your account or your access to all or any part of the Service, with or without notice, for any reason or no reason, in our sole discretion.
• Sections 5 (license you grant us), 7 (intellectual property), 9 (disclaimer), 10 (limitation of liability), 11 (indemnification), 13 (governing law), and this Section 12 will survive any termination of these Terms.

13. Governing law and venue

These Terms are governed by and construed under the laws of the State of Florida, USA, without regard to its conflict-of-laws principles. You and Contingency Entertainment LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of Katye will be brought exclusively in the state or federal courts located in Broward County, Florida, and you irrevocably consent to the personal jurisdiction and venue of those courts.

14. Changes to these Terms

We may update these Terms at any time. We will update the “Last updated” date above. For material changes, we will take reasonable steps to notify users — for example, by an in-app banner or by email to the address on your account. Continued use of Katye after changes take effect means you accept the updated Terms. If you do not agree to the updated Terms, stop using Katye and delete your account.

15. Severability and waiver

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. The unenforceable provision will be construed to give the maximum permissible effect to its original intent. Our failure to enforce any provision is not a waiver of the right to enforce it later.

16. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Contingency Entertainment LLC regarding Katye, and supersede any prior agreements between us on this subject.
