Terms of Use

Welcome to Katye (the “App” or “Service”), operated by Contingency Entertainment LLC(“Contingency Entertainment,” “we,” “us,” or “our”), a Florida limited liability company. These Terms of Use (“Terms”) govern your access to and use of the App. By creating an account, signing in, tapping “I agree,” or otherwise using Katye, you accept and agree to be bound by these Terms. If you do not agree, do not use Katye.

By creating an account, signing in, or using Katye, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy, which is incorporated by reference. These Terms form a binding contract between you and Contingency Entertainment.

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use Katye for your personal, non-commercial entertainment. We may revoke this license at any time, in our sole discretion, for any reason.

5. User-generated content and gameplay data

When you vote, pick a team, choose a display name, complete a puzzle, or take any other action in Katye, you grant Contingency Entertainment an irrevocable, perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, display, aggregate, and analyze your gameplay actions and any content you submit, for the purpose of operating the Service, computing leaderboards, producing aggregated statistics, generating marketing materials, and improving the Service.

You represent and warrant that any display name or other content you submit (a) is accurate, (b) does not infringe the intellectual property, privacy, publicity, or other rights of any third party, (c) is not unlawful, hateful, defamatory, obscene, or harassing, and (d) does not impersonate any other person.

8. Third-party services and stores

Katye integrates with third-party services including, without limitation, Google AdMob, Google OAuth, Apple Sign in with Apple, Supabase (authentication + database), OneSignal (push notifications), Firebase (Android push delivery), and the Apple App Store and Google Play Store. Your use of those services is governed by their own terms and policies. We are not responsible for third-party services or their content.

Advertising. Katye is supported by ads served through Google AdMob. We do not control which specific ads are shown to you.

In-app purchases and subscriptions.Katye may offer optional purchases or subscriptions (such as Katye Premium). All purchases are processed by Apple or Google through their respective stores under their terms. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period; manage or cancel renewals in your device’s subscription settings.

9. Disclaimer of warranties

Katye is provided “as is” and “as available” without warranties of any kind, express or implied. To the fullest extent permitted by applicable law, Contingency Entertainment LLC, its members, officers, employees, contractors, and affiliates disclaim all warranties, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, title, accuracy, completeness, availability, reliability, and quiet enjoyment.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. You use the Service at your sole risk.

10. Limitation of liability

To the maximum extent permitted by applicable law, in no event will Contingency Entertainment LLC, its members, officers, employees, contractors, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; for any loss of profits, revenue, data, goodwill, business opportunities, or use; or for any cost of substitute services, whether arising from contract, tort (including negligence), strict liability, or any other legal theory, and even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for any and all claims arising out of or relating to these Terms or your use of Katye will not exceed the greater of (a) the total amount you have paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) USD $100.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities; in those jurisdictions, the disclaimers and limitations above apply to the maximum extent permitted by applicable law.

11. Indemnification

You agree to defend, indemnify, and hold harmless Contingency Entertainment LLC, its members, officers, employees, contractors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees and litigation costs) arising out of or related to (a) your use or misuse of Katye, (b) your breach of these Terms, (c) your violation of any applicable law, (d) your violation of any third party’s rights (including intellectual property and privacy rights), or (e) any content you submit through the Service.

13. Governing law and venue

These Terms are governed by and construed under the laws of the State of Florida, USA, without regard to its conflict-of-laws principles. You and Contingency Entertainment LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of Katye will be brought exclusively in the state or federal courts located in Broward County, Florida, and you irrevocably consent to the personal jurisdiction and venue of those courts.

14. Changes to these Terms

We may update these Terms at any time. We will update the “Last updated” date above. For material changes, we will take reasonable steps to notify users — for example, by an in-app banner or by email to the address on your account. Continued use of Katye after changes take effect means you accept the updated Terms. If you do not agree to the updated Terms, stop using Katye and delete your account.

15. Severability and waiver

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. The unenforceable provision will be construed to give the maximum permissible effect to its original intent. Our failure to enforce any provision is not a waiver of the right to enforce it later.

16. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Contingency Entertainment LLC regarding Katye, and supersede any prior agreements between us on this subject.
